This day this cause came on to be heard on the petition and exhibits and it appearing to the Court that due and legal notice of the pendency of this petition has been published and the Court being fully advised in the premises finds that the statements in the petition are true therefore it is ordered that George Frank Reuben Harmon and Guy Smith Judicious freeholders and disinterested men of the vicinity shall upon actual view of the premises and upon their oaths assign & set off to said Widow of said Joseph Smith Jr as her dower the one equal third part of said Real estate in the petition described and truly and impartially appraise said real estate at its fair cash value subject to said dower and make return of their appraisement to this Court forthwith

It being made to appear to the Court that Guy Smith one of the appraisers heretofore appointed in this case is temporarily absent from his home and by reason thereof is unable to perform his duties as such appraiser It is therefore by the Court ordered that A. S. [Alvin Stone] Richards a Judicious disinterested freeholder of the vicinity be appointed in the stead of said Guy W Smith and shall with George Frank & Reuben Harmon the appriasers heretofore appointed perform the duties required by the order heretofore issued to said George Frank Reuben Harmon and Guy Smith

To George Frank Reuben Harmon & Guy Smith Greeting: Pursuant to an order of the Probate Court within and for said County made the 24th day of October AD 1861 you are hereby required to proceed and after having been duly sworn or affirmed set off and assign to Widow of Joseph Smith Jr by metes and bounds or specially as of rents and profits in case no division can be made one full equal third part in value of the following described real estate as her dower to wit Situate in the Township of in Lake County in the State of viz and is the same land conveyed to said Joseph Smith Jr deceased by Samuel Canfield by deed dated Oct 1, 1836 [p. 84]
